Terms & Conditions

1. Scope and Provider
These Terms and Conditions (AGB) apply to all registered users of the “EcoLogistik” app, provided by EifelFlow GbR, Hauptstraße 33, 54647 Pickließem, Germany (hereinafter referred to as the “Provider”).

Deviating conditions of the users shall not apply unless the Provider has explicitly agreed to their validity in writing.
2. Subject of the Agreement
The Provider offers a technical platform that allows users to post or accept transportation requests.
The Provider is not a contractual party to transportation agreements concluded via the platform and assumes no responsibility for their initiation, execution, or fulfillment.
The Provider does not act as a representative, intermediary, or agent of the users.
There is no entitlement to a specific availability or functionality of the app.
3. Registration and Use
•Registration is required to use the app.
•Users must be at least 18 years old and must provide accurate information.
•Login credentials must be kept confidential and not shared with third parties.
•The Provider reserves the right to refuse registrations without providing reasons.
4. User Roles
The app offers the following roles:
a) Sender/Recipient – individuals or companies that request transportation.
b) Driver/Transporter – individuals or companies that perform transportation services.
A user may assume multiple roles simultaneously.
5. User Obligations
Users agree to use the app only within the intended functionality and, in particular, to refrain from:
• posting unlawful, offensive, or misleading content;
• infringing the rights of third parties (e.g., copyright, trademarks, personal rights);
• processing or disclosing personal data without authorization;
• performing technical manipulations that may impair the operation of the app;
• violating applicable legal obligations (e.g., transport permits, insurance requirements, traffic laws).
Users also agree to comply with applicable data protection laws (especially GDPR and BDSG), including:
• no unauthorized sharing of personal data of other users;
• using personal data strictly for purposes related to the app;
• deleting personal data immediately once it is no longer required.
Users may upload only content for which they hold the necessary rights.
The Provider is entitled to delete content or block users in case of violations of these obligations.
6. Services of the Provider
The Provider makes the platform available in its current version.
There is no claim to constant availability or to specific app functions.
The Provider may modify, expand, or discontinue the app at any time.
7. Data Protection
The processing of personal data takes place exclusively in accordance with the Provider’s privacy policy and applicable data protection laws (GDPR).
Use of the app is not possible without acceptance of the privacy policy.
8. Liability
•The Provider is fully liable for intent, gross negligence, or injury to life, body, or health.
•In cases of slight negligence involving essential contractual obligations (cardinal duties), liability is limited to the foreseeable, typically occurring damage.
•Any further liability is excluded.
The Provider is particularly not liable for:
• the accuracy or completeness of user information;
• the initiation or performance of transportation contracts;
• damages resulting from non-performance, delays, or poor performance between users;
• data loss, system failures, or unauthorized access by third parties;
• violations of data protection laws (especially GDPR and BDSG) committed by users or misuse of personal data by users.
9. Termination and Account Blocking
•Users may delete their account at any time.
•The Provider may block or terminate user accounts without notice in the event of violations of these AGB.
•After termination, the Provider may delete or anonymize data unless statutory retention obligations apply.
10. Intellectual Property
All content, logos, and texts within the app are owned by the Provider or properly licensed.
Users grant the Provider a non-exclusive, geographically and temporally limited right to use content they upload, insofar as necessary for the operation of the platform.
11. Costs and Services
The use of the app is currently free of charge.
Future paid features will be clearly marked and require the user’s explicit consent.
12. Changes to the Terms
The Provider reserves the right to amend these AGB.
Users will be informed at least 14 days before changes take effect.
If the user does not object within this period, the changes are considered accepted.
Users will be explicitly informed of their right to object.
13. Applicable Law and Jurisdiction
German law applies.
For merchants, legal entities under public law, or special public funds, the place of jurisdiction is the Provider’s registered office.
Statutory provisions on exclusive jurisdictions remain unaffected.
14. Severability Clause
If individual provisions of these AGB become invalid, the validity of the remaining provisions shall remain unaffected.
